Please read these Terms and Conditions ("Terms") carefully before using the services provided by Dawnwell ("we", "us", "our"). By submitting an enquiry, entering into a service agreement, or using our website, you acknowledge that you have read and agreed to these Terms. These Terms are governed by the laws of Taiwan (Republic of China).
1. Definitions
- "Service" โ any in-home elderly care programme offered by Dawnwell, including Transition & Adjustment Support, Specialized Cognitive Companionship, and the Elite Personal Attendant arrangement
- "User" / "Client Family" โ the individual or family who enters into a care arrangement with Dawnwell
- "Care Recipient" โ the elderly individual for whom care is provided
- "Aide" / "Attendant" โ the trained care professional placed by Dawnwell
- "Agreement" โ the written service agreement between Dawnwell and the Client Family
2. Acceptance of Terms
By proceeding with an initial consultation or submitting a contact form, you confirm that you are at least 18 years of age and have the legal capacity to enter into a service agreement on behalf of yourself and, where applicable, on behalf of the care recipient.
3. Services Provided
Dawnwell provides in-home elderly care services in Tainan, Taiwan. The specific scope, duration, and schedule of care are set out in the individual service agreement. Services are available in the following programme formats:
- Transition & Adjustment Support (two to six weeks)
- Specialized Cognitive Companionship (ongoing, multi-session weekly schedule)
- Elite Personal Attendant (ongoing, fully dedicated arrangement)
Dawnwell reserves the right to decline or discontinue a service arrangement where it determines it is unable to meet the care recipient's needs adequately.
4. Service Commencement
Care begins only after a written service agreement has been signed and any applicable deposit or first payment has been received. An introductory visit will be arranged between the aide and the care recipient before regular care commences.
5. User Responsibilities
By entering into an agreement with Dawnwell, the Client Family agrees to:
- Provide accurate and complete information about the care recipient's needs, health context, and daily circumstances
- Maintain a safe and respectful working environment for Dawnwell aides and staff
- Notify Dawnwell promptly of any changes to the care recipient's health or circumstances that may affect the service
- Not direct or instruct aides to perform tasks outside the agreed scope of service
- Make service payments in accordance with the agreed schedule
6. Acceptable Use of Website
Users of the Dawnwell website agree not to:
- Misrepresent their identity or affiliations
- Attempt to access restricted areas of the site
- Use the site for any unlawful purpose or in violation of applicable laws in Taiwan
7. Intellectual Property
All content on the Dawnwell website โ including text, layout, logos, and service descriptions โ is the property of Dawnwell and protected under applicable intellectual property laws. You are granted a limited, non-exclusive licence to view and use the website for personal, non-commercial purposes. You may not reproduce, distribute, or modify any content without prior written consent.
8. Payment Terms
Service fees are payable as set out in the individual service agreement. We accept bank transfer and other payment methods as agreed at intake. All fees are quoted and payable in New Taiwan Dollars (NT$). Where an arrangement is extended beyond its original scope, updated fees will be communicated and agreed in writing before application. Late payments may result in temporary suspension of the service.
9. Cancellation and Refunds
Cancellation terms are set out in the individual service agreement. In general:
- Cancellations made more than 7 days before care commencement are eligible for a full refund of any deposit paid
- Cancellations made within 7 days of care commencement may forfeit any deposit paid
- For ongoing arrangements, a minimum of 14 days' written notice is required to discontinue service
- Dawnwell reserves the right to terminate an arrangement with immediate effect in exceptional circumstances (including unsafe working conditions or material misrepresentation at intake)
10. Limitations and Disclaimers
Dawnwell's services are non-medical in nature. Our aides provide personal care, companionship, and daily living assistance โ not clinical assessment, nursing care, or medical treatment. We do not make representations about health outcomes. Families with medical care needs should engage appropriate registered medical or nursing practitioners.
Our website and service information are provided in good faith, but we do not warrant that all information will be error-free or uninterrupted.
11. Limitation of Liability
To the extent permitted by law, Dawnwell's total liability in connection with any service or claim shall not exceed the total fees paid for the specific service arrangement in question. We shall not be liable for indirect, consequential, or incidental loss. Nothing in these Terms limits liability for death or personal injury caused by negligence, or for any other liability that cannot be excluded under Taiwan law.
12. Indemnification
By entering into a service agreement, the Client Family agrees to indemnify Dawnwell against any claims, losses, or damages arising from inaccurate information provided at intake or from actions taken by the Client Family or care recipient that result in harm to Dawnwell staff or third parties.
13. Termination
Either party may terminate the service arrangement by providing written notice as specified in the service agreement. Upon termination, care will conclude on the agreed end date. Any outstanding fees for services delivered remain payable.
14. Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution through direct, good-faith discussion. If unresolved within 30 days, the dispute shall be subject to mediation in Tainan before any formal legal proceedings are initiated. These Terms and any service agreements are governed by the laws of the Republic of China (Taiwan), and any litigation shall be conducted in the courts of Tainan District.
15. Changes to These Terms
Dawnwell may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of our website or services after any revision constitutes acceptance of the updated Terms. We recommend reviewing this page periodically.
