Terms & Conditions

Please read these Terms and Conditions ("Terms") carefully before using the services provided by Dawnwell ("we", "us", "our"). By submitting an enquiry, entering into a service agreement, or using our website, you acknowledge that you have read and agreed to these Terms. These Terms are governed by the laws of Taiwan (Republic of China).

By proceeding with an initial consultation or submitting a contact form, you confirm that you are at least 18 years of age and have the legal capacity to enter into a service agreement on behalf of yourself and, where applicable, on behalf of the care recipient.

Dawnwell provides in-home elderly care services in Tainan, Taiwan. The specific scope, duration, and schedule of care are set out in the individual service agreement. Services are available in the following programme formats:

Dawnwell reserves the right to decline or discontinue a service arrangement where it determines it is unable to meet the care recipient's needs adequately.

Care begins only after a written service agreement has been signed and any applicable deposit or first payment has been received. An introductory visit will be arranged between the aide and the care recipient before regular care commences.

All content on the Dawnwell website โ€” including text, layout, logos, and service descriptions โ€” is the property of Dawnwell and protected under applicable intellectual property laws. You are granted a limited, non-exclusive licence to view and use the website for personal, non-commercial purposes. You may not reproduce, distribute, or modify any content without prior written consent.

8. Payment Terms

Service fees are payable as set out in the individual service agreement. We accept bank transfer and other payment methods as agreed at intake. All fees are quoted and payable in New Taiwan Dollars (NT$). Where an arrangement is extended beyond its original scope, updated fees will be communicated and agreed in writing before application. Late payments may result in temporary suspension of the service.

Dawnwell's services are non-medical in nature. Our aides provide personal care, companionship, and daily living assistance โ€” not clinical assessment, nursing care, or medical treatment. We do not make representations about health outcomes. Families with medical care needs should engage appropriate registered medical or nursing practitioners.

Our website and service information are provided in good faith, but we do not warrant that all information will be error-free or uninterrupted.

11. Limitation of Liability

To the extent permitted by law, Dawnwell's total liability in connection with any service or claim shall not exceed the total fees paid for the specific service arrangement in question. We shall not be liable for indirect, consequential, or incidental loss. Nothing in these Terms limits liability for death or personal injury caused by negligence, or for any other liability that cannot be excluded under Taiwan law.

12. Indemnification

By entering into a service agreement, the Client Family agrees to indemnify Dawnwell against any claims, losses, or damages arising from inaccurate information provided at intake or from actions taken by the Client Family or care recipient that result in harm to Dawnwell staff or third parties.

13. Termination

Either party may terminate the service arrangement by providing written notice as specified in the service agreement. Upon termination, care will conclude on the agreed end date. Any outstanding fees for services delivered remain payable.

14. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through direct, good-faith discussion. If unresolved within 30 days, the dispute shall be subject to mediation in Tainan before any formal legal proceedings are initiated. These Terms and any service agreements are governed by the laws of the Republic of China (Taiwan), and any litigation shall be conducted in the courts of Tainan District.

15. Changes to These Terms

Dawnwell may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of our website or services after any revision constitutes acceptance of the updated Terms. We recommend reviewing this page periodically.
